Direct selling companies seems to have got a clean chit especially from the Government. In a statement to the Lok Sabha, the Minister of state for Consumer Affairs, Food and Public Distribution said, " The Provision of the Prize Chit and Money Circulation Scheme (Banning) Act, 1978 seeks to ban the promotion or conduct of Prize Chit and Money Circulation Schemes. The Provisions of this Act had come up for scrutiny before the Supreme Court of India, which has ruled that the 'Network Marketing Plan' and direct sale of goods and services by the direct selling companies do not fall within the mischief of the aforesaid Act"

The India Direct Selling Association (IDSA) in a press release said, "This answer gains significance in the backdrop of genuine Direct Selling business being wrongly equated with illegal money rolling/ pyramid companies. This answer should put to rest any doubt that may have arisen on the applicability of Prize Chit and Money Circulation Scheme (Banning) Act, 1978 to Network Marketing or Direct Selling Companies."

The subscriber / applicant should read and understand the Terms & Conditions and the Opportunity before you sign up for the subscription. This Online Subscriber Relationship Form (SRF) is considered as an authentic and bindings legal document and together with the above, forms the entire subscription between the subscriber (herein after referred to as the Member) and GetMax India (herein after referred to as the Company)

Definitions

"Company" shall mean MRS Infotech (P) Ltd., having registered office at No.2,Chanma International, Big Bazaar Street, Coimbatore-641001, TamilNadu, INDIA, its successors and assigned.
"Subscriber/Applicant" shall mean any person, company, proprietorship or partnership firms, any other associates of person or entity of whatever nature, who has subscribed for Package (Global E-Directory and the Benefited Program) thru online and include Subscriber's heirs, executors, administrators, successors and permitted assigns.
"Package" shall mean it includes the Subscription of Global Web Directory and Participation of Benefited Program (optionally). Details available in the Catalogue/Brochure and Website.
"Global E-Directory" shall mean your name, address, phone numbers, emails, profession/occupation and any other details, which you want others to know about you.
"Benefited Program" shall mean Internet based subscription development program that empowers its referrals to subscribe membership in order to earn benefits.

Provision of Services:

  • The Company may temporarily suspend whole part of the functions at anytime without notice, if the Network fails or requires modification or maintenance.
  • These terms and conditions shall become effective, upon the company, as its sole discretion, accepting after receipt of payment for subscription.
  • The Company reserves the right to reject any application, for any reason without any liability, the information provided by the subscriber/gathered by the company shall become the Company's property even if application is rejected.
  • The result available in the Web Directory is based on Information given by the subscribers

Rights and Liabilities of the Company:

  • The company shall be responsible for providing the online function to the subscriber subject to the terms and condition mentioned herein.
  • The Company reserves the rights to seek / verify particulars provided by the subscriber to the company, in any manner without notice or intimation.
  • The Company reserve the rights to provide functions (online service) through its office and website.
  • The Company reserves the right to change, modify, and or alter the terms and conditions of Subscription at its own discretion, at any without prior notice or intimation to the subscriber.
  • The Company will rely on the accuracy of the Online Subscriber Relationship Form submitted, in its data processing. The applicant should ensure that all information is correct and properly entered. Any mistake in Referrer ID (Member ID) or Placement information (Available in Allocation Method) cannot be re-altered or change.
  • The Company will confirm approval of Subscription by issuing an online receipt (for non-refundable subscription amount). Company Provides or allots the Membership ID or Relationship ID (for identification of subscribers) to the subscribers after registration and it will function after receiving the payment for the subscription.
  • The Company is entitled to alter, modify, amend of package or change the benefited program, terms and conditions, offers choices, combination and compensation plan from time to time without notice and the applicant agrees to be bound by the same.
  • The company is entitled and is at liberty to take any action including legal proceedings and claim complete and full indemnity from the subscriber / applicant for any loss or damage caused in any manner to the company, besides terminating the subscription without any compensation.
  • The company has rights to cancel the subscription without any notice in the circumstances herein explained, or under such other circumstances which will be against interests of the company (i) If any Member (existing subscriber) is engaging in supporting or involving in any activities such as insinuation speeches, defoliating the interest of the peoples or other subscribers which will be detrimental to the welfare, reputation or image or benefited program of the company. (ii) If the Member (existing subscriber) is found cross sponsoring or cross recruiting the subscribers by any mode.
  • The company is not responsible for completeness and accuracies of the materials or information provided on websites. Since the websites and connected functions are related to web signal system, company will not be, in any circumstances responsible for the problems, losses, delays, damages arising from the loss of connectivity, error in content due to Online Subscriber Relationship Form problems and loss of access temporary or permanent loss of data.
  • The Jurisdiction for any disputes is Coimbatore only.

Duties and Responsibilities of the Subscriber

  • The subscriber / applicant is submitting this Online Subscriber Relationship Form to GetMax India for their Subscription and Membership for Benefited Program and declares that he/she has attained the age of 18 years prior to this Subscription Relationship Form and is lawfully competent to apply and subscribe with the company by remitting non-refundable subscription fees.
  • The subscriber / applicant understands that the company reserves the rights to accept or decline this Online Subscriber Relationship Form without assigning any reasons. Upon acceptance of the Online Subscriber Relationship Form by the company, applicant authorizes the company to store and use any data or information, present or future relating to the Membership ID in any lawful manner as they deem fit. The subscriber can use this ID for any future reference with the company.
  • The subscriber / applicant understands this subscription becomes operative and effective from the date of payment made by the applicant and also it is valid for one year from the date of payment and shall be renewable as decided by the company.
  • The subscriber / applicant understands that he/she has to pay subscription fee and registration fee as decided by the company in order to become an independent subscriber / member of the company.
  • On acceptance of this Online Subscriber Relationship Form for Subscription the subscriber / applicant shall be known as independent subscriber and shall be bound by Instruction of the company, for all the terms and conditions, rules and regulations, governing the subscription.
  • The subscriber / applicant should know the subscription cannot be changed, assigned or transferred to any person without the prior consent of the company.
  • The subscriber/ applicant is aware that he/she is only an Independent subscriber of the company by remitting the subscription and registration fee and not an employee, agent or legal representative of the company and not entitled to any benefits, remedies that may be available for employees or agents or legal representative of the company. He/She shall not solicit or sponsor employees of the company as a subscriber.
  • The existing subscribers / members should promote no other Network Marketing / Concepts inside presentations/office premises. If so, the company has the right to terminate his subscription contract immediately.
  • The Member (existing subscriber) confirms that he/she shall not introduce or sell any package (with offers) or other services, which are not approved / provided by the company through the Network of subscribers.
  • The Member (existing subscriber) agrees to use the promotional materials of the company for the purposes for which the company has provided them and will not reproduce, reprint or otherwise make use of it, its contents themes partially or fully for any other purposes or will not use them to mislead, misinterpret in any manner which will be against the interests of the company.
  • The subscriber indemnifies and holds the Company harmless against all claims made by any third party and any related damages in the expenses arising out and are connected with subscribers conduct.
  • The subscriber / applicant agrees to subscribe that only after fully satisfying the quality and functionality of the package and fully understanding the Opportunity (Benefited Program) he enters into this agreement and the subscriber / applicant shall not raise any dispute or claim with the company in future with regard to the quality and functionality of the package and the benefited program (business concept).
  • The Member (existing subscriber) is aware that a person who desires of subscribing GetMax and its benefited program (business concept) should be clear in the terms & conditions and satisfying in the explanation of benefits and packages, also attend the concept seminar. Before the subscribing of new subscription, Member (existing subscriber) should obtain the self-declaration from him/her for his/her understanding the Packages (with offers) and Compensation plan. For any violation in this regard, Member (existing subscriber) is solely responsible for the consequential and losses.
  • The Subscriber (with his Membership ID or Relationship ID) shall use the GetMax name to promote only GetMax Opportunity (Benefited Program).
  • The responsibility of the subscriber to hold the password for the user name allotted to him/her confidential and the company will be in no way responsible for any consequences arising on account of the subscribers act of not keeping the password confidential and or his/her inability to make use of the password in a proper and lawful manner.
  • Neither the company nor the subscriber will be held culpable for delays in performance caused by circumstances beyond the control of either party.
